A friend and colleague has been suspended from duty. You are convinced they have done nothing wrong and they will be reinstated once the investigation concludes, but the process is dragging on. They would like to meet up socially. What do you do?

Case Studies

  • What about maintaining a social relationship with someone who has retired before a disciplinary process was completed?
  • What about if it was a family member?
  • What about if it is you, and you are waiting to clear your name?

Discussion

It is likely that there will be different considerations or restrictions on professional social conduct depending on the case and the officer’s restrictions, so each case may be different. Whilst there may be no specific restrictions on you, it might be wise to consider:
  • What constitutes social contact? What types of contact are included? Is there a difference between a text message to check someone is ok and a telephone call? What about a quick catch-up in a cafe or pub? No contact means just that, but is there a difference between professional and social? What happens if you are related to them? It would be sensible to ensure that you are clear regarding the expectations in this situation.
  • Is the process fair and just? How does it respect the presumption of innocence?
  • Handling disciplinary matters sensitively and comprehensively is essential, though it can take time. Understanding the reasons for delays can be challenging.
  • While individuals on restricted duties or enforced absence continue to receive pay, their limited social and professional interactions can lead to profound negative outcomes. This situation can also be difficult for the organisation and remaining staff, who must meet requirements with fewer resources.
  • Would the meet-up conditions change based on what the allegations are and would that matter in the context of this discussion?
  • Achieving a balance between thoroughness and efficiency in disciplinary processes is crucial, but it is unclear if this balance is consistently maintained.
